Auto lawyer Lev Voropaev named three cases in which the court cancels a fine from traffic violation recording cameras.
The court will cancel a fine issued by a photo and video recording camera if it is reliably established that there was actually no violation of traffic rules. The absence of an event of offense is the main and unconditional basis for canceling the decision.
The second case is related to the fact that another person was driving. If the car was transferred to the driver under a power of attorney or used by a tenant, the owner can challenge the fine. To do this, it is necessary to contact the traffic police together with the actual driver before the expiration of the statute of limitations.
If the department refuses, the decision can be appealed in court, where the fine is usually canceled if the fact of driving by another person is confirmed.
The third basis is a malfunction or lack of a valid calibration of the camera. If the measuring device has not passed the inspection within the prescribed period, its data cannot be considered proof of violation.
