A court can assign fault for an accident not only to the driver, but also to a passenger. This is possible if the person in the cabin interfered with the driving during movement and provoked an accident, said auto lawyer Lev Voropaev.
According to him, this refers to situations when a passenger tries to grab the steering wheel, pulls it to the side, or otherwise prevents the driver from controlling the car.
If these actions led to a collision, responsibility may be assigned to the passenger, especially if there are serious consequences for the accident participants.
These are isolated situations, but the passenger will be blamed for the incident, especially if it is associated with serious consequences.
At the same time, Voropaev emphasized that in most accidents, responsibility remains with the driver. He is responsible for the safety of transportation, for the behavior of people in the cabin, and for the very fact of allowing access to vehicle control.
