What a traffic cop can't do during inspection

A car lawyer explained in which cases a traffic police officer has no right to inspect a car and open elements of the interior

A traffic police officer does not have the right to inspect a car without following the mandatory procedure. This was stated by car lawyer Lev Voropaev.

According to him, the inspection will be considered illegal if it is carried out without witnesses, without video recording, without drawing up a corresponding protocol, or without making a note of the inspection. In addition, the procedure cannot be carried out in the absence of the owner of the vehicle.

The lawyer emphasized that the inspector is obliged to strictly comply with the regulations. Otherwise, his actions may be appealed.

Separately, Voropaev noted that cutting or opening seats does not apply to inspection. Such actions go beyond the scope of control and supervisory measures. They can only be carried out by a court decision or with the sanction of an investigator. Otherwise, such actions will be recognized as illegal.

It is important for drivers to know their rights and record possible violations of the procedure by the inspector.
