The Third Cassation Court of General Jurisdiction has allowed the seizure of cars from drunk drivers in Russia, regardless of their financial situation. The precedent was set by the case of a car owner who was caught driving while intoxicated twice.
The first time, the daredevil got off with an administrative penalty, the second time a criminal case was opened against him.
The court sentenced the offender to 240 hours of compulsory labor, deprived him of his driver's license for two years, and also confiscated the Mercedes-Benz CLA 200 to the state.
Seeking the return of the car, the driver reached the cassation, but did not succeed. The court noted that the application of the rule does not depend on the living conditions and financial situation of the convicted person.
For the court, it is sufficient to have a combination of two circumstances - the ownership of the vehicle by the convicted person and its use by the convicted person while intoxicated with recidivism.
